Good point……but if Comex defaults and JPM is a short and has phys and does not deliver, then the creditors will go after JPM….so they lose their phys and are still short the balance and will be persued for that metal…..they will have to declare Force Majeur on the balance, to get out of delivering and cash settle.
Net they lose big time.
